Not a black kite,first thoughts are always buzzard as they are are variable in size and markings, however the hovering is characteristic of a short toed eagle and the markings look right.The problem is size ,wing span of the eagle is 20% bigger than a hen harrier but at a distance that is difficult to tell. I have seen short toed eagle here so it's not impossible and a buzzard would certainly not see off a hen harrier.
